These Terms of Use (the "Terms") govern access to and use of the website located at abbytires.com (the "Website"), operated by Abby Tires & Auto Repair (the "Company", "we", "us" or "our"). In these Terms, "you" means any person who accesses or uses the Website.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website.

1. Pricing is indicative and does not constitute an offer

1.2 The price applicable to any particular customer depends on the vehicle concerned, the size, offset and fitment required, the parts sourced, the condition of components identified upon inspection, and applicable taxes, levies and environmental fees.

1.3 Prices, product availability and specifications are subject to change without notice.

1.4 A binding price arises only upon issuance by the Company of a written quotation in respect of a specific vehicle, prior to the commencement of work. Where, in the course of performing work, the Company determines that additional parts or labour are required beyond those quoted, the Company will seek your authorisation before proceeding.

2. Product information and availability

2.1 The wheels and tires presented on the Website constitute a selection of the Company's range and do not represent a complete or current inventory. Display of a product on the Website does not constitute a representation that the product is in stock in any particular size, finish or bolt pattern.

2.2 Product images are supplied by manufacturers or are representative illustrations. Finishes may appear materially different on screen from their actual appearance owing to photography, lighting conditions and display calibration. You should confirm the exact finish, diameter, width, offset and fitment with the Company prior to placing an order.

2.3 Brand names, product names and trademarks referred to on the Website are the property of their respective owners and are used solely for the purpose of identifying products supplied or fitted by the Company. Their use does not imply affiliation with, endorsement by, or sponsorship by any manufacturer unless expressly stated.

3. Quotation requests and appointments

3.1 Submission of a quotation or booking form through the Website constitutes a request only and does not create a confirmed appointment or a contract for the supply of goods or services.

3.2 An appointment is confirmed only upon the Company communicating confirmation to you by telephone, text message or email.

3.3 You are asked to provide reasonable notice of any cancellation or rescheduling so that the service bay may be reallocated.

4. Third-party financing

4.1 Financing referred to on the Website is provided by independent third-party finance companies and not by the Company. The Company does not extend credit.

4.2 Approval, credit limits, interest rates, fees, payment schedules and all other terms of any credit arrangement are determined by the finance provider in its sole discretion and are subject to its assessment and terms.

4.3 Any figures generated by the financing calculator on the Website are illustrative only, do not account for interest, fees or taxes unless expressly stated, and constitute neither an offer of credit nor a representation that credit will be approved.

5. Goods and workmanship

5.1 Work performed by the Company is warranted on the terms stated on the invoice issued in respect of that work.

5.2 Parts and tires supplied by the Company carry the warranty of the applicable manufacturer and are administered in accordance with that manufacturer's terms.

5.3 Nothing in these Terms operates to exclude, restrict or modify any statutory condition, warranty, guarantee or right conferred on you by the Business Practices and Consumer Protection Act (British Columbia), the Sale of Goods Act (British Columbia), or any other applicable law, where such exclusion, restriction or modification is not permitted.

6. Customer reviews

Customer reviews reproduced on the Website are genuine and are quoted from publicly available listings. They reflect the individual experiences of the customers concerned and do not constitute a representation, warranty or guarantee as to the outcome of any work performed for you.

7. Permitted use

7.1 You agree not to:

• submit false, misleading or fraudulent information through any form on the Website;
• submit automated, repetitive or bulk form submissions;
• attempt to gain unauthorised access to the Website, its server, or any connected system or network;
• introduce any virus, malicious code or other harmful material; or
• interfere with, disrupt or impose an unreasonable load upon the Website.

7.2 The Company reserves the right to decline to respond to any submission and to restrict access to the Website where these Terms are breached.

8. Intellectual property

The design, layout, text, graphics, source code and compilation of the Website are the property of the Company or are used under licence, and are protected by applicable intellectual property laws. 9. Availability and disclaimer

9.1 The Company endeavours to maintain the accuracy and availability of the Website but does not warrant that it will be uninterrupted, error-free, secure, or current at any given time.

9.2 Save as expressly provided in these Terms and subject to Section 5.3, the Website is provided on an "as is" and "as available" basis, without warranty or condition of any kind, whether express or implied.

10. Limitation of liability

10.1 To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential or exemplary loss or damage arising out of or in connection with your use of, or reliance upon, the Website, including without limitation any decision made in reliance upon an indicative price displayed on the Website.

10.2 Nothing in this Section limits or excludes the Company's liability in respect of goods supplied or work performed on your vehicle, nor any liability that cannot lawfully be limited or excluded.

11. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You submit to the exclusive jurisdiction of the courts of British Columbia in respect of any dispute arising out of or in connection with these Terms or the Website.

12. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

13. Amendments

The Company may amend these Terms from time to time. The version published on this page is the version in force, and the effective date is stated above. Continued use of the Website following the publication of amended Terms constitutes acceptance of those amendments.
